SelfServeLaw Terms
Welcome to SelfServeLaw. By using the services on the SelfServeLaw website you are agreeing to the following terms.
GENERAL

Before you may use the services provided by SelfServeLaw, you must read and accept all of the terms and conditions in this Terms of Use Agreement and the Privacy Policy. We strongly recommend that, as you read these Terms of Use, you also access and read the linked definitions.

This Agreement is effective on January 1, 2009, for current users, and upon acceptance for new users. The previous amendment to this Agreement was effective for all users on November 9, 2008.

When SelfServeLaw changes or amends the Terms of Use Agreement the new Terms of Use Agreement will be posted on the website and will apply to all users of our website from that day forward without any additional notice.

This Agreement may not be otherwise amended except in a written document signed by both you and an authorized officer of SelfServeLaw.

In our sole discretion, we may assign this Agreement in accordance with the Notices section.

Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

We do not guarantee we will take action against all breaches of this Agreement.

No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term.

Headings are for reference purposes only and do not limit the scope or extent of such section.

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.
USER RESPONSIBILITIES
While using SelfServeLaw, you MAY NOT:

Violate any applicable laws or third-party rights;

Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consent to do the same;

Use any material or information, including images or photographs, which are made available through our sites in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party;

Distribute viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs or any other technologies that may harm in any way SelfServeLaw, or in any way SelfServeLaw users;

Copy, modify, or distribute content from the sites;

Use the Services in any manner that could damage, disable, overburden, or impair any SelfServeLaw server, or the network(s) connected to any SelfServeLaw server, or interfere with any other party's use and enjoyment of any Services;

Attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any SelfServeLaw server or to any of the Services, through hacking, password mining or any other means;

Obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services;

Harvest or otherwise collect information about others, including e-mail addresses.

You agree to regularly visit this page which contains the Terms of Use so as to familiarize yourself with any changes or amendments.

In order to open an account and use the services provided by SelfServeLaw, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form.

You are entirely responsible for maintaining the confidentiality of your password and account.

Furthermore, you are entirely responsible for any and all activities that occur under your account.

You agree to notify SelfServeLaw immediately of any unauthorized use of your account or any other breach of security.

SelfServeLaw will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge.

However, you could be held liable for losses incurred by SelfServeLaw or another party due to someone else using your account or password.

You may not use anyone else's account at any time, with or without the permission of the account holder.

Without limiting other remedies, we may limit, suspend, or terminate our service and user accounts, prohibit access to our website, delay or remove hosted content, and take technical and legal steps to keep users off the sites if we think that they are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of our policies. We also reserve the right to cancel unconfirmed accounts or accounts that have been inactive for a long time.

You agree that using the website and services provided by SelfServeLaw does not constitute the provision of legal advice to you and no solicitor - client relationship exists unless and until we have mutually entered into a written legal retainer agreement.
LIABILITIES, INDEMNITIES, AND LEGAL RELATIONSHIPS

You agree that all decisions you make on legal matters are your sole responsibility and you agree to retain legal counsel licensed to practice in your jurisdiction regarding any legal issue of enough importance to reasonably require it.

Except as expressly provided in these Terms, you agree to accept full responsibility for determining the value of and for any use you make of the services provided by SelfServeLaw, and for obtaining any needed assistance from a properly licensed attorney to assess the value of and appropriate uses for any documents created by the use of SelfServeLaw.

For the purposes of these Terms, Legal Advice is defined to include the following:
a- any legal related communication, work or service which, under the governing law of your jurisdiction, is only allowed to be performed by or under the supervision of a properly licensed attorney;
b- advice related to your specific legal or fact situation;
c- advice on which legal document or documents you need or are best for your situation;
d- advice applying the law or drawing any legal conclusions;
e- determining the legal consequences that will or could result from how you have created your legal document;
f- whether you have included inappropriate, conflicting, or ambiguous information in your legal documents;
g- whether you have omitted any necessary provisions or details from your legal documents; and
h- whether you require any additional legal documents or legal procedures. -
If you reside in British Columbia, Canada (to be expanded as we gain referral advertisements...), you have the option of submitting your completed document to a local law firm (e.g. Roger Batchelor Law Corporation) for the specific purpose of obtaining legal advice. SelfServeLaw is not responsible for any consequences or liabilities arising from your use of an independent law firm.

You will not hold SelfServeLaw responsible for other users' content, actions or inactions.

We cannot guarantee continuous or secure access to our services, and operation of the sites may be interfered with by numerous factors outside of our control.

Accordingly, to the extent legally permitted, we exclude all implied warranties, terms and conditions. SelfServeLaw is not liable for any loss of money, goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of, or inability to use, our sites, whether based on warranty, contract tort, or any other legal theory, and whether or not SelfServeLaw is advised of the possibility of such damages. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.

Regardless of the previous paragraph, if we are found to be liable, the maximum liability of SelfServeLaw to you or to any third party is limited to the greater of either the amount paid to SelfServeLaw by a customer for using the services provided or CAN $100.

You will indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees), harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.

No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

SelfServeLaw's sites may contain links to third party Web sites. These links are provided solely as a convenience to you and not as an endorsement by SelfServeLaw of the contents on such third-party Web sites. SelfServeLaw is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third party Web sites. If you decide to access linked third-party Web sites, you do so at your own risk.
NOTICES

Except as explicitly stated otherwise, any notices shall be given by registered mail to SelfServeLaw at c/o 103-2220 Sooke Road, Victoria, British Columbia, Canada, V9B 0G9 (in the case of SelfServeLaw) or to the email address you provide to SelfServeLaw during the registration process (in your case). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you notice by certified mail, postage prepaid and return receipt requested, if you have provided a mailing address to SelfServeLaw. In such case, notice shall be deemed given 3 days after the date of mailing.
DISPUTE RESOLUTION

If a dispute arises between you and SelfServeLaw, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. Accordingly, you and SelfServeLaw agree that we will resolve any claim or controversy at law or equity that arises out of this Agreement or our services (a "Claim") in accordance with one of the subsections below or as we and you otherwise agree in writing. Before resorting to these alternatives, we strongly encourage you to first contact us( This e-mail address is being protected from spambots. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

This Agreement shall be governed in all respects by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You agree that any claim or dispute you may have against SelfServeLaw must be resolved by a court located in Victoria, British Columbia, except as otherwise agreed by the parties. You agree to submit to the personal jurisdiction of the courts located within Victoria, British Columbia for the purpose of litigating all such claims or disputes.

All claims you bring against SelfServeLaw must be resolved in accordance with this Resolution of Disputes section. All claims filed or brought contrary to the Resolution of Disputes section shall be considered improperly filed. Should you file a claim contrary to the Resolution of Disputes Section, SelfServeLaw may recover attorneys' fees and costs up to C$1500, provided that SelfServeLaw has notified you in writing of the improperly filed claim, and you have failed to promptly withdraw the claim.
